Welcome to Bigfoot Adventures Ltd. These Terms and Conditions ("Terms") govern your use of our website and services. By booking with us or using our website, you agree to be bound by these Terms. Please read them carefully before making any bookings.
Acceptance of Terms
By accessing our website, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
These Terms apply to all users of our website and services, including clients, website visitors, and any other users of our services.
Booking and Payment
Booking Process
- All bookings are subject to availability and confirmation by Bigfoot Adventures
- A booking is confirmed only when we send written confirmation
- We reserve the right to decline any booking at our discretion
- All prices are quoted in USD unless otherwise specified
Payment Terms
- A deposit of 30% is required to confirm your booking
- Full payment is due 45 days before departure
- Payments can be made via bank transfer, credit card, or other approved methods
- All bank charges and transaction fees are the responsibility of the client
- Prices may be subject to change due to currency fluctuations or increased costs
Cancellation Policy
Client Cancellations
Cancellation charges apply as follows from the date of confirmed booking:
- More than 45 days before departure: 30% of total cost
- 31-45 days before departure: 50% of total cost
- 15-30 days before departure: 75% of total cost
- Less than 15 days before departure: 100% of total cost
Our Cancellations
We reserve the right to cancel any trip due to insufficient bookings, safety concerns, or circumstances beyond our control. In such cases, we will provide a full refund or offer alternative arrangements.
Travel Requirements
Documentation
- Valid passport with at least 6 months validity
- Appropriate visas for Kenya and any other countries visited
- Yellow fever vaccination certificate (if applicable)
- Travel insurance covering medical expenses and evacuation
Health and Safety
- Clients must be in good health and fitness for safari activities
- Any medical conditions must be disclosed at time of booking
- Malaria prophylaxis may be recommended for certain areas
- Clients participate in activities at their own risk
Liability and Insurance
Our Liability
Bigfoot Adventures acts as an agent for various service providers including hotels, lodges, airlines, and ground operators. Our liability is limited to the arrangements we make on your behalf. We are not liable for:
- Acts or omissions of third-party service providers
- Personal injury, illness, or death except where caused by our negligence
- Loss or damage to personal property
- Delays, cancellations, or changes to itineraries beyond our control
- Costs arising from missed connections or delayed flights
Insurance Requirements
All clients must have comprehensive travel insurance covering:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Personal property and baggage
- Personal liability coverage
Force Majeure
We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather conditions
- War, terrorism, civil unrest, or political instability
- Government actions, travel restrictions, or border closures
- Pandemics or health emergencies
- Strikes, labor disputes, or transportation failures
- Technical failures or cyber attacks
Conduct and Safety
All clients are expected to:
- Follow all safety instructions and guidelines provided by guides
- Respect local customs, cultures, and wildlife
- Not engage in activities that may endanger themselves or others
- Comply with all local laws and regulations
- Treat staff, guides, and fellow travelers with respect
We reserve the right to refuse service or terminate arrangements for clients who violate these standards.
Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Bigfoot Adventures Ltd. and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our written permission.
Dispute Resolution
We are committed to resolving any disputes amicably. If you have any complaints or concerns:
- Contact us immediately to discuss the issue
- We will investigate and respond within 14 days
- If unresolved, disputes may be referred to mediation
- Any legal proceedings must be initiated within one year of the incident
Governing Law
These Terms and Conditions are governed by the laws of Kenya. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the Kenyan courts.
